These Terms of Service ("Terms") govern your use of the Alakazam app ("App"), provided by Luma ("we", "us", or "our"). By using the App you agree to them. If you do not agree, do not use the App. Who you are agreeing with is set out at the end of these Terms.
Eligibility
You must be at least 13, or older if your country sets a higher age for agreeing to online services, and able to enter into a binding agreement.
The Service
Alakazam helps you find the full-length YouTube video a clip was taken from. You submit a link to a YouTube video, and the App suggests the video it most likely came from. Results are suggestions and are not always correct.
The App creates an account for you the first time you open it; you do not sign in. Your search history stays with that account on your device. An active subscription can be restored on a new device from the purchase screen with the same Apple ID.
Alakazam is independent and is not affiliated with or endorsed by YouTube or Google. Product names and trademarks belong to their owners.
Acceptable Use
You agree not to:
- use the App unlawfully, or to identify, track or harass anyone;
- submit links to content that is not publicly accessible or that you have no right to share;
- use the App to scrape or systematically collect data;
- use automated means to run searches, or get around the subscription or any search limit;
- interfere with the App or its infrastructure, or reverse engineer it except where the law allows.
Subscriptions, Payment and Refunds
The App is free to download, but running searches requires a subscription after the free trial. We sell two auto-renewing subscriptions, Alakazam Standard and Alakazam Premium, each monthly or yearly. The price in your currency is shown in the App before you buy.
What a subscription includes. Each includes a number of searches per week, resetting every Monday, and a search-history period; Premium includes more of both. The purchase screen shows exactly what each includes. A fair-use limit also caps how many searches an account can start in a short period, to prevent abuse. If you hit a limit, the App tells you when you can search again.
Free trial. New subscribers get a free trial whose length is shown before you commit. Apple decides eligibility.
Subscriptions renew automatically and your Apple ID is charged for each new period unless you cancel at least 24 hours before the current one ends. Cancel any time in Settings → your name → Subscriptions; you keep access until the paid period ends. You can switch between Standard and Premium in the same place.
If a plan's price rises, Apple asks you to agree before you are charged the new price. If you do not agree, the subscription does not renew.
Changes to what a subscription includes. We may reduce the searches a subscription includes, including for active subscriptions, when needed because of what the service costs to run, the limits of services we depend on, or to prevent abuse. We will tell you in the App at least 30 days in advance, and a reduction applies to you only from your first renewal after that notice, so you can cancel before it affects you. We may act sooner only to stop abuse, keep the service running, or comply with the law.
Apple is the seller and takes the payment; we never see your card or Apple ID. Your purchase is also governed by the Apple Media Services Terms and Conditions. Refunds are handled by Apple at reportaproblem.apple.com. If something has gone wrong, email us too.
Right of withdrawal. If you are a consumer in the EU, EEA or UK, you normally have 14 days to withdraw from a contract for digital content. Because a subscription starts immediately, by buying one you ask us to begin straight away and accept that you lose that right once it has started. This does not affect your rights if the service is faulty.
Licence and Intellectual Property
We give you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial purposes. The Alakazam name, logo and code are ours. Videos the App points to belong to their creators.
If you are a rights holder with a complaint about content the App references or caches, email us with the details and we will review it promptly.
Apple App Store Terms
Because you obtained the App from the Apple App Store:
- This agreement is with us, not Apple. Apple is not responsible for the App or its content.
- Licence. You may use the App only on Apple devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Support. We alone are responsible for support and maintenance.
- Warranty. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the App. Apple has no other warranty obligation.
- Claims. We, not Apple, are responsible for any claim relating to the App, including product liability, legal or regulatory compliance, consumer protection, privacy, and intellectual property claims.
- Export compliance. You confirm you are not in a country under a U.S. Government embargo or designated as terrorist-supporting, and not on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries may enforce these Terms against you.
Warranties and Liability
The App is provided "as is" and "as available". We do not promise that it will be uninterrupted or error-free, or that any result is correct. To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of data, profits or opportunity, arising from your use of the App.
Nothing in these Terms limits liability that cannot be limited by law, or your mandatory rights as a consumer where you live.
Ending the Agreement
You can stop using the App and ask us to delete your account at any time; cancel your subscription with Apple first. We may suspend or end your access if you breach these Terms, put the service or others at risk, or the law requires it, and where reasonable we will tell you why first.
We may change, suspend or discontinue the App. If we discontinue it, we will give reasonable notice and stop selling subscriptions before we stop the service.
Changes to These Terms
We will post changes here and update the date above, and tell you in the App if a change materially affects your rights. Continuing to use the App means you accept the updated Terms.
Governing Law
These Terms are governed by Danish law. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and can bring proceedings there.
